Legal terms and conditions governing access to and use of the Color Experience Platform

These Terms of Use govern access to and use of the web application app.colorexperiencesystem.com (the "Platform"), operated by Stichting Nederlands Kleur Instituut (SNKI) under license from Stichting Xconea, the holder of all intellectual property rights to the Color Experience System (CXP).

By creating an account or using the Platform, you agree to these Terms of Use.

1 Ownership and Licensing

The Color Experience System (CXP) and all related materials, tools, data models, and content are managed by Stichting Xconea.

SNKI operates the Platform as a licensed distributor and service provider.

All rights not expressly granted remain with the respective owners.

2 Access and Subscriptions

Access to the Platform is provided on a paid annual subscription basis.

  • Small studios and individual users may subscribe and pay via Stripe.
  • Larger studios and organizations are invoiced directly by SNKI.

Subscriptions are personal and non-transferable unless explicitly agreed otherwise.

Access may be suspended if payments are not received within the agreed period.

3 Use of the Platform

Users agree to:

  • use the Platform only for lawful and professional purposes;
  • not copy, modify, or redistribute materials, datasets, or algorithms without written consent from SNKI or Xconea;
  • maintain confidentiality of login credentials and account data.

Unauthorized reproduction or misuse of any part of the Color Experience System is strictly prohibited.

4 Intellectual Property

All software, algorithms, color models, documentation, and visual materials remain protected by copyright and other applicable intellectual property laws.

No ownership rights are transferred to users.

Users receive only a limited, non-exclusive, non-transferable license to use the Platform within the agreed subscription term.

5 Payments and Renewal

Subscriptions are billed annually in advance.

⚠️ No Refunds Policy
Refunds are not provided once access has been activated.

SNKI reserves the right to adjust pricing or features at renewal, with reasonable notice.

6 Data Protection

Personal data is handled according to our Privacy & Cookie Policy, compliant with the EU General Data Protection Regulation (GDPR).

7 Disclaimer and Limitation of Liability

The Platform and its content are provided "as is", without any warranty of completeness or accuracy.

SNKI and Xconea accept no responsibility for:

  • typographical or computational errors,
  • color calculation deviations,
  • interpretation errors or user decisions based on system output,
  • any direct, indirect, incidental, or consequential damages resulting from use of the Platform.
⚠️ Important Notice
Use of the Platform and reliance on its results are entirely at your own risk.

8 Termination

SNKI may terminate access immediately in case of non-compliance with these Terms.

Users may terminate their subscription at the end of their annual term by written notice.

9 Governing Law and Jurisdiction

These Terms are governed by Dutch law.

Any dispute shall be submitted to the Court of Haarlem, the Netherlands.

10 Changes to These Terms

We may update these Terms from time to time.

The latest version will always be available at app.colorexperiencesystem.com/terms. Continued use of the Platform constitutes acceptance of any revisions.
